Fair Debt Collection Practices Act (FDCPA)
The Fair Debt Collection Practices Act (FDCPA) is an act designed to protect consumers from unfair debt collection practices. The act is enforced by the Federal Trade Commission (FTC) and prohibits debt collectors from certain practices that would be considered deceptive, abusive, or unfair. The act bans debt collectors from harassment of consumers or making threats in their attempts to recover a debt. It also prohibits them from making false or misleading statements (for example, telling an individual they'll be arrested if they don't pay their debt). The act further allows consumers to limit the time of day during which debt collectors contact them regarding their debt. If debt collectors are told orally or in writing that they may not call during certain hours, they must abide by those restrictions.
